Reasons for Collecting Information

This policy applies to our activities in fundraising, telemarketing, events we organise and supporter management, and outlines how we collect, use and disclose personal information about our supporters and our contact records.

We collect personal information where it is reasonably necessary for our functions or activities for charity, for fundraising and as required by law. Electronic marketing messages to you comply with the Spam Act 2003 (Cth) as a result of an exemption from that Act for communications from an ACNC-registered charity.

How We Collect Information

We collect contact or personal information directly from you. This information may be collected from a number of sources including responses to appeal letters and coupons, telephone enquiries and sales, donations, payments, event entry forms, merchandise sales, advertisement response forms, purchase of goods and services, mail services or otherwise, requests for information about our services, and via our websites for those purposes.

We may also receive information from third parties, such as a relative or other person who wishes to give you entries or suggest that you support us. Where information is received from a third party, we will identify that to you and we require your apparent or express consent to continue to use the information, or it will be deleted.

We may record our phone conversations, for which a notification is provided. In each of these sources, we believe it will be reasonably apparent that our purpose is to seek your support for charitable fundraising, for MOW NSW’s raffle and for its charitable purposes.

You will be notified of our continued interest in contacting you and of your right to decline to receive further contact from us. Please see the contact information below to let us know.

The information we collect is limited to personal information which may include name, age, gender, contact details and payment information, and to preferences, experience or knowledge of relevant issues, opinions and feedback which may help us improve your experience and our service delivery to you.

A purpose for which we collect personal information includes marketing. We may send marketing material to you where the material is related to a purpose for which you provided information, and the material provides you with an opportunity to stop or opt out of receiving further communications.

MOW NSW may contact you directly where contact details have been acquired via information in the public domain, such as phone book data, or from data suppliers. We use reliable mailing list companies, telemarketers, banking services and other suppliers who are also bound by the Privacy Act to reach new potential supporters.

We maintain the information we receive for accuracy and completeness. We do this during our contact with you and from external sources.

Where required, for example for accuracy or to act on your request to decline further contact, we may update the supplier of contact information for changes in the information you give us, in accordance with this policy and that supplier’s privacy policy.

How We Use Information

We may receive requests for purchases and queries about your support from you. We use received information to act on your request or instruction, to update and maintain personal and contact information we hold, to update and maintain mailing lists, and to contact new supporters.

Where required, for example for accuracy or to act on your requests, we may update contact information for changes and corrections, and update current suppliers’ records as used for the fundraising.

Information Security

We take all reasonable measures to keep any information held about you secure and to keep this information accurate and up to date.

Information collected is kept in secure locations, including in electronic form on secured servers, and is encrypted during transmission or in storage where required.

Access to personal information is restricted to authorised personnel who require it to perform their duties. Contracted suppliers are required to provide data security including firewalls, router settings and virus and interception protection.

Retention of Information

We do not retain information about you which is no longer required or not in use for fundraising. We dispose of records, files, letters and payment records in a secure manner, subject to raffle rules, and require suppliers to delete records from their systems as soon as possible after completion of each task.

We are required to retain certain contact and payment information to do our work, including to enable you to make a payment, donation or purchase, and to comply with record-keeping rules for the conduct of raffles.

We will consider all requests to process a transaction on an anonymous basis, but we may be unable to do so.

Advertising and Marketing

We may use Google AdWords Remarketing and/or Facebook Remarketing to advertise across the internet, in particular on the Google Display Network and Facebook Network.

These services display advertisements to you based on what parts of the website you have viewed, by placing a cookie on your web browser. This cookie does not identify you or give access to your computer or mobile device.

Spam Act 2003 and Do Not Call Register 2006

MOW NSW is a registered charity and, when our communications relate directly to charitable fundraising, appeals or raffle participation, they are generally exempt from the prohibition on unsolicited commercial electronic messages under the Spam Act 2003 (Cth).

Charities are also permitted to contact individuals on the Do Not Call Register for the purpose of charitable fundraising under the Do Not Call Register Act 2006 (Cth).

When telephoning supporters, we otherwise comply with the requirements of that Act.

Overseas Processing

We ensure that service providers which process personal information do so only according to an agreement which includes standards at least equivalent to those which would apply if that service provider were located in Australia.

Some of our service providers are located in the United Kingdom, the United States (for example, cloud servers and Google Analytics) and the Philippines.

This includes service providers who provide artificial intelligence capabilities described below, which may operate on systems located outside Australia.

Where this is the case, we take reasonable steps to ensure your information receives protections consistent with the Australian Privacy Principles.

Use of Artificial Intelligence

We use artificial intelligence tools to help us provide our services more efficiently and accurately, including to assist with customer support, fraud detection and data accuracy checking. These tools may process your personal information for these purposes.

Our use of artificial intelligence is subject to human oversight. Where artificial intelligence assists in a decision that may affect you, such as fraud detection, that decision remains subject to human review.

If you believe an AI-assisted decision has affected you incorrectly, you may contact us using the details below to request a review.

Third-party providers who assist us in delivering AI capabilities including any model training using anonymous data are engaged under contractual arrangements that require them to handle your information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

Social Media and Direct Channels

We maintain a presence on third-party social media platforms, including Facebook, Instagram, LinkedIn, TikTok and X, to publicise the raffle and engage with supporters.

Your use of those platforms, and any information you provide to us through them, is also subject to that platform’s own privacy policy and terms of use, which we do not control.

If you contact us, or provide your contact details to us through a social media platform’s messaging function or a lead-generation form, we will handle that information in the same way as other personal information collected directly from you under this policy.

Feedback, Queries or Complaints

You are entitled to know what information about you we hold, to correct that information, or to ask us to delete it. We will give you access to the information we hold about you. We may ask you to pay for document retrieval if that is necessary.

If you are dissatisfied about any aspect of our privacy policy in relation to your contact information, please contact us. We are happy to consider all feedback, provide answers and, where necessary, act on any reasonable or legal request. We may need to identify you for that purpose.
